COVID Clause 52.223-99

Please find Acquisition Alert 22-03, which provides FPDS reporting instructions for contract actions issued to incorporate clause 52.223-99.

 

The Office of Management and Budget, Office of Federal Procurement Policy has mandated that agencies centrally report the implementation of Executive Order 14042 Ensuring Adequate COVID Safety Protocols for Federal Contractors in the Federal Procurement Data System (FPDS).  Executive Order (E.O.) 14042 was signed by the President on September 9, 2021, and published in the Federal Register at 86 FR 50985 on September 14, 2021.  The E.O. requires agencies to include clause 52.223-99 which requires contractors and subcontractors at any tier to comply with all guidance for contractor workplace locations as published by the Safer Federal Workforce Task Force (Task Force Guidance).  Clause Deviation Number 22-01 was issued to implement this clause requirement and prescribes when the clause should be included.da
